These Terms of Use (“Terms”) govern your access to and use of the Resplora platform, including our website, booking system and related services.

By creating an account, booking a session, or using our platform, you agree to be bound by these Terms.

If you do not agree, you must not use our services.

Resplora provides an online platform that connects clients with independent mental health practitioners.



3. Platform Role

Resplora is a technology platform only.
Practitioners are independent contractors
Resplora does not provide clinical services
Clinical responsibility rests solely with the practitioner



4. Telehealth Disclaimer

Services may be delivered online via telehealth.

Telehealth may not be suitable for all situations and is not a substitute for emergency or crisis care.

If you are in immediate danger or crisis, call 000 (Australia) or your local emergency provider.



5. Eligibility

To use our services, you must:
be at least 18 years old, or
have consent from a parent or legal guardian

You confirm that you are legally able to enter into this agreement.



6. Accounts

You agree to:
provide accurate and complete information
keep your details up to date
maintain the confidentiality of your login credentials

You are responsible for all activity under your account.



7. Bookings

By booking a session, you agree to:
attend at the scheduled time
provide accurate booking information
comply with the Cancellation Policy



8. Payments
All sessions are prepaid at the time of booking
Payments are processed via secure third-party providers (e.g. Stripe)

You confirm that you are authorised to use your payment method.



9. Cancellation

Cancellations and rescheduling are subject to the Cancellation & Refund Policy.



10. Medicare and Rebates
You are responsible for confirming your eligibility
A valid referral (e.g. Mental Health Treatment Plan) may be required
Resplora does not guarantee rebate outcomes



11. User Responsibilities

You agree to:
participate respectfully
provide accurate information relevant to your care
attend sessions from a private environment
not record sessions without consent



12. Third-Party Services

We may use third-party providers (e.g. Stripe, video platforms).

We are not responsible for their systems or availability.



13. Limitation of Liability

To the extent permitted by Australian law:
Resplora is not responsible for clinical outcomes
Services are provided by independent practitioners

Nothing in these Terms excludes rights under Australian Consumer Law.



14. Suspension or Termination

We may suspend or terminate access if:
you breach these Terms
required for safety or legal reasons



15. Changes to Terms

We may update these Terms from time to time.

Continued use means you accept the updated Terms.



16. Governing Law

These Terms are governed by the laws of Australia.
